This AI Disclaimer applies to all artificial-intelligence and machine-learning features of the Kappino platform (the “Service”), operated by TechVerdi SA, Av. Charles-Ferdinand Ramuz 60, 1009 Pully, Switzerland. It forms part of, and should be read together with, our Terms & Conditions and Privacy Policy.

Switzerland does not currently have a dedicated AI statute; the AI features are governed by general Swiss law, including the Federal Act on Data Protection (FADP) for automated decisions and profiling, and the Swiss Code of Obligations for contractual matters. This Disclaimer explains the limits of the AI features and the responsibilities that remain with you.

Kappino’s AI and machine-learning features may include, among others:

• an AI copilot and administrative assistance;
• recommendations and smart suggestions;
• demand and sales forecasting;
• customer segmentation and churn prediction; and
• the OCR / AI Scanner, which extracts and parses data from uploaded documents, such as invoices and menus.

These features use a combination of internal machine-learning services and third-party AI providers.

All output generated by the AI features — including recommendations, forecasts, scores, predictions, summaries, and extracted data — is provided for informational and supportive purposes only. It is intended to assist your decision-making, not to make decisions for you, and it does not constitute advice, instruction, or a recommendation to take any particular action.

AI systems are probabilistic and have inherent limitations. AI output may be inaccurate, incomplete, outdated, biased, or unsuitable for your specific circumstances, and may occasionally produce errors or fabricated content (“hallucinations”).

Forecasts and predictions are estimates based on historical and available data and do not guarantee future results. Data extracted by the OCR / AI Scanner may contain recognition or parsing errors. We do not warrant the accuracy, completeness, reliability, or fitness for a particular purpose of any AI output.

You should independently review, verify, and validate AI output before relying on or implementing it — particularly for anything with operational, financial, legal, employment, or safety implications.

For the OCR / AI Scanner, extracted data should be checked and approved by a person before it is used or stored as accurate. Treat AI output as a starting point that requires human judgement, not a final answer.

You remain solely responsible for all decisions you make and actions you take, whether or not informed by AI output, including your operational, financial, and legal decisions — for example, pricing, purchasing and inventory, staffing and scheduling, marketing, and compliance choices.

You are responsible for ensuring that your use of the AI features and any resulting decisions comply with applicable law and with the rights of third parties. We are not responsible for decisions you make based on AI output.

The AI features do not provide legal, financial, tax, accounting, medical, or other professional advice, and using them does not create any professional or advisory relationship. Where you need professional advice, please consult a suitably qualified professional.

Some features involve profiling, such as segmentation, forecasting, churn prediction, and recommendations. These are designed to support human decision-making.

We do not make decisions producing legal or similarly significant effects about an individual based solely on automated processing without a lawful basis and appropriate safeguards. Where such decision-making occurs, the affected person has the right to obtain human review, to express their point of view, and to contest the decision, as provided under Art. 21 of the FADP and Art. 22 of the GDPR.

Where you use AI features in relation to your own customers or staff, you are responsible for meeting any corresponding obligations as their controller.

Certain AI features rely on third-party providers, including OpenAI and Google Cloud Vision for OCR, which may process data outside Switzerland and the EU/EEA under appropriate safeguards.

How personal data is processed by the AI features — and the option to disable AI processing on request — is described in our Privacy Policy. You should not submit to the AI features any data you are not permitted to share, and you should avoid submitting unnecessary sensitive information.

To the fullest extent permitted by applicable law, we are not liable for any loss or damage arising from your reliance on, or use of, AI output, including operational, financial, or legal consequences.

This Disclaimer is subject to the limitations and exclusions of liability in the Terms & Conditions. Nothing here excludes or limits any liability that cannot be excluded under mandatory Swiss law, including, under Art. 100 of the Swiss Code of Obligations, liability for unlawful intent or gross negligence, or liability for death or personal injury caused by negligence.

We may update this AI Disclaimer from time to time to reflect changes in our features or the law; material changes will be notified and the “Last updated” date revised.

This Disclaimer is governed by Swiss law, excluding its conflict-of-law rules and the CISG. The competent courts of the Canton of Vaud, Switzerland — place of jurisdiction: Pully / Lausanne — have exclusive jurisdiction, subject to any mandatory place of jurisdiction.
